Code amnesty for older structures

January 2016 update: Parts of the current ordinance run out in June 2016. The Board of Adjustment is discussing that the end date be extended, or removed entirely, and that the fee be waived. Read the proposed changes, and the Board’s rationale. The Planning Commission Codes and Ordinances Committee will consider this at their January 19 meeting.

The City Council has authorized special exceptions and fee waivers for some longstanding residential code violations that do not threaten public safety or negatively impact surrounding properties. This allows some property owners to apply for an amnesty to setback requirements for structures more than 10 years old. Particularly in Georgian Acres, Mockingbird Hill, and other older sections of our neighborhood, this may be available to houses where many years ago the carport was enclosed or extended down the driveway into the front setback.
